Nazivi "Brewellent", "mi", "nas" ili "naš" u ovim Uslovima odnose se na gore navedeni privredni subjekat. Nazivi "vi" ili "korisnik" odnose se na svako fizičko ili pravno lice koje pristupa ovom veb sajtu.

Šta nudimo

Brewellent pruža personalizovana kraft piva, po vašem izboru recepta, ukusa i dizajna, za privatne žurke ili brend.

Proces:

Stil piva. Naš tim vas vodi kroz izbor kako bi došlo do onoga što najviše odgovara vašoj publici i povodu. Pivo se kuva od delikatnih sastojaka, po izabranom receptu.
Dizajn. Ime, pun brend, fotografije, to su samo neki od elemenata koji se mogu naći na vašem pivu. Ukoliko nemate spreman dizajn, pružamo profesionalan grafički dizajn.
Punjenje i pakovanje. Nakon što smo završili sa prethodnim koracima, vaše pivo punimo u posebne etiketirane i namenjene ambalaže.
Isporuka. Zapakovano pivo stiže do vas na dogovorenu adresu, u dogovorenom roku, što je idealno za posebne datume. Pokrivamo Beograd i okolne krajeve, izuzev posebnih situacija.
Kategorije klijenata

Brewellent pruža usluge sledećim kategorijama klijenata:

Korporativni klijenti i poslovni događaji. Kompanije, agencije i organizatori poslovnih događaja koji naručuju personalizovano pivo za teambuildinge, godišnjice, konferencije, promotivne aktivnosti i poslovne poklone. Odnos između Brewellenta i korporativnog klijenta reguliše se kao B2B ugovorni odnos u skladu sa Zakonom o obligacionim odnosima.

Specijalni događaji i festivali. Organizatori javnih i privatnih događaja, festivala, sajmova i sličnih skupova koji zahtevaju veće količine personalizovanog piva ili piva sa brendiranjem događaja. I ovaj odnos reguliše se kao B2B ili kao ugovor sa fizičkim licem organizatorom, zavisno od pravnog statusa naručioca.

Privatna lica, proslave i žurke. Fizička lica koja naručuju personalizovano pivo za rođendane, venčanja, momačka i devojačka veča, godišnjice i slične privatne prilike. Na ugovore zaključene sa fizičkim licima kao potrošačima primenjuju se odredbe Zakona o zaštiti potrošača Republike Srbije (Sl. glasnik RS br. 62/2014 i izmene), uključujući pravo na reklamaciju i prigovor.

Narudžbine i ugovor

Brewellent nastupa kao agentski posrednik između klijenta i ovlašćenog proizvođača koji proizvodi, puni i skladišti pivo te poseduje sve zakonom propisane dozvole za proizvodnju i promet alkoholnih pića na teritoriji Republike Srbije. Brewellent organizuje i koordiniše proces po narudžbini klijenta, uključujući odabir recepta, izradu dizajna etikete i organizaciju isporuke.

U svim slučajevima, predmet ugovora je koordinacija usluge izrade personalizovanog proizvoda po narudžbini. Svaki proizvod nastaje isključivo na osnovu konkretne narudžbine i prema specifikacijama klijenta.

Brewellent fakturiše klijentu ukupnu vrednost usluge i robe u svoje ime, a deo koji se odnosi na samu proizvodnju i robu izmiruje se prema ovlašćenom proizvođaču po posebnom međusobnom aranžmanu. Klijent u svakom trenutku ima pravo da zatraži podatke o ovlašćenom proizvođaču čiji proizvod prima.

Upiti podneti putem ovog veb sajta predstavljaju zahtev za informaciju ili ponudu, a ne potvrđenu narudžbinu. Obavezujući ugovor nastaje tek po pisanoj potvrdi narudžbine od strane Brewellenta, u skladu sa odredbama Zakona o obligacionim odnosima Republike Srbije.

Zadržavamo pravo da odbijemo ili otkažemo narudžbinu po sopstvenom nahođenju, uključujući slučajeve kada tražena usluga nije dostupna, postoji greška u opisu ili ceni, ili iz bilo kog drugog razloga ispunjenje nije moguće. U takvim slučajevima, eventualno izvršena uplata biće vraćena u celosti i bez odlaganja.

Minimalne količine narudžbine, rokovi i cene saopštavaju se posebno i mogu se razlikovati u zavisnosti od formata i količine. Konkretni datumi isporuke garantuju se isključivo kada su potvrđeni u pisanoj formi.

Pored koordinacije procesa proizvodnje, Brewellent je u mogućnosti da pruži i dodatne usluge kao što je profesionalni grafički dizajn etiketa, prema posebnom dogovoru.

Prava potrošača

Na ugovore zaključene sa fizičkim licima koja nastupaju kao potrošači primenjuju se sledeće odredbe u skladu sa Zakonom o zaštiti potrošača:

Pravo na reklamaciju. Potrošač ima pravo da izjavi reklamaciju u slučaju nesaobraznosti isporučenog proizvoda sa ugovorenim specifikacijama. Reklamacija se podnosi pisanim putem na adresu strahinja.calic@proton.me najkasnije u roku od dva meseca od dana kada je nesaobraznost otkrivena. Brewellent je obavezan da odgovori na reklamaciju u roku od osam dana od prijema.

Nemogućnost odustanka od ugovora. Kako je svaki proizvod izrađen isključivo prema specifikacijama konkretnog potrošača i nema mogućnost dalje prodaje trećim licima u neizmenjenom obliku, potrošač nema pravo na jednostrani odustanak od ugovora bez naknade nakon što je proces proizvodnje pokrenut, u skladu sa članom 37. stav 1. tačka 3. Zakona o zaštiti potrošača koji isključuje pravo odustanka za robu izrađenu po meri potrošača.

Prigovori. Potrošač može podneti prigovor u vezi sa pruženom uslugom pisanim putem na gore navedenu adresu. Brewellent je obavezan da razmotri svaki prigovor i da odgovori u zakonskom roku.

Odgovornost za ispunjenje usluge

Brewellent organizuje i koordiniše uslugu u celosti, ali varenje, punjenje i skladištenje vrši ovlašćeni poslovni partner. Brewellent ne može biti smatran odgovornim za kašnjenja, nedostatke ili propuste koji su isključivo posledica postupanja tog partnera, ukoliko su svi razumni koraci sa naše strane preduzeti u cilju ispunjenja usluge.

Brewellent preuzima odgovornost za koordinaciju procesa, tačnost prosleđenih instrukcija klijenata prema partneru i organizaciju isporuke do klijenta.

Intelektualna svojina

Sav sadržaj na ovom veb sajtu, uključujući tekstove, grafike, logoe, slike, grafičku opremu etiketa i vizuelni identitet brenda Brewellent, isključivo je vlasništvo Strahinja Ćalić PR i zaštićen je odredbama Zakona o autorskom i srodnim pravima Republike Srbije (Sl. glasnik RS br. 104/2009 i izmene) i relevantnim međunarodnim konvencijama.

Nije dozvoljeno kopiranje, reprodukovanje, izmena niti distribucija sadržaja ovog veb sajta bez prethodne pisane saglasnosti, osim za lično, nekomercijalno korišćenje.

Sadržaj prilagođene etikete

Isključivo ste vi odgovorni za sadržaj koji dostavljate za štampu etiketa. Dostavljanjem sadržaja potvrđujete i garantujete da posedujete ili imate pravo na korišćenje svih tekstova, slika, logoa i ostalih materijala koje dostavljate; da dostavljeni sadržaj ne krši intelektualnu svojinu trećih lica u smislu Zakona o autorskom i srodnim pravima, Zakona o žigovima i Zakona o industrijskom dizajnu; da sadržaj nije klevetnički, uvredljiv, obscen niti nezakonit; i da sadržaj ne promoviše nezakonite aktivnosti, govor mržnje niti diskriminaciju u smislu Zakona o zabrani diskriminacije.

Brewellent zadržava pravo da odbije ili ukloni bilo koji sadržaj koji po našoj proceni krši ove uslove ili može izložiti kompaniju pravnom ili reputacionom riziku. Klijent se obavezuje da nadoknadi Brewellentu svaku štetu, troškove ili gubitke nastale po osnovu zahteva trećih lica u vezi sa sadržajem koji je dostavio klijent.

Alkohol i starosno ograničenje

U skladu sa važećim propisima koji regulišu promet alkoholnih pića u Republici Srbiji, Brewellent ne pruža usluge licima mlađim od 18 godina. Korišćenjem ovog veb sajta i plasiranjem narudžbine potvrđujete da imate najmanje 18 godina.

Zadržavamo pravo da odbijemo narudžbine u slučaju osnovane sumnje da kupac ne ispunjava ovaj uslov. Brewellent ne odgovara za lažno prikazivanje starosti od strane korisnika, niti za eventualnu dalju distribuciju proizvoda od strane kupca trećim licima.

Ograničenje odgovornosti

U najvećoj meri dozvoljenoj važećim propisima, a u skladu sa Zakonom o obligacionim odnosima Republike Srbije, Strahinja Ćalić PR ne odgovara za posrednu, slučajnu ili posledičnu štetu nastalu korišćenjem ovog veb sajta ili naših usluga; greške ili netačnosti u sadržaju veb sajta nastale bez namere ili grube nepažnje; privremenu nedostupnost veb sajta usled okolnosti van naše razumne kontrole, uključujući tehničke kvarove, više sile ili postupanje trećih lica; niti za štetu nastalu kao posledica nepravilnog rukovanja ili skladištenja proizvoda od strane klijenta nakon preuzimanja.

Ukupna odgovornost Brewellenta po osnovu bilo kog zahteva koji proističe iz pojedinog ugovora ne može preći iznos koji je klijent platio za tu konkretnu narudžbinu.

Ništa u ovim Uslovima ne isključuje niti ograničava odgovornost za smrt ili telesnu povredu prouzrokovanu namerom ili grubom nepažnjom, niti bilo koji drugi vid odgovornosti koji se ne može isključiti u skladu sa prisilnim propisima Republike Srbije.

Kolačići i zaštita podataka o ličnosti

Ovaj veb sajt koristi kolačiće. Neophodni tehnički kolačići koriste se bez vašeg pristanka jer su neophodni za funkcionisanje sajta. Opcioni analitički kolačići zahtevaju vaš prethodni pristanak, koji možete povući u bilo kom trenutku putem podešavanja pretraživača.

Merodavno pravo i nadležnost

Ovi Uslovi korišćenja zaključeni su i tumače se u skladu sa propisima Republike Srbije. Za sve sporove koji proisteknu iz ili u vezi sa ovim Uslovima, stranke se obavezuju da će najpre pokušati mirno rešenje u roku od 30 dana od nastanka spora. Ukoliko spor ne bude rešen mirnim putem, nadležan je stvarno i mesno nadležan sud u Republici Srbiji, prema sedištu privrednog subjekta.

What We Do

Brewellent provides personalised craft beer by your choice of recipe, flavour, and design, for private occasions, events, and brand use.

The process:

Beer style. Our team guides you through the selection to find what best suits your audience and occasion. The beer is brewed from quality ingredients according to your chosen recipe.
Design. Your name, full brand, photos, these are just some of the elements that can appear on your beer. If you do not have a ready design, we provide professional graphic design.
Filling and packaging. Once the previous steps are complete, your beer is filled into specially labelled, purpose-made packaging.
Delivery. Your packaged beer is delivered to the agreed address within the agreed timeframe, ideal for important dates. We cover Belgrade and the surrounding area, with exceptions available upon request.
Client Categories

Brewellent provides services to the following categories of clients:

Corporate clients and business events. Companies, agencies, and business event organisers ordering personalised beer for team-building events, anniversaries, conferences, promotional activities, and corporate gifts. The relationship between Brewellent and a corporate client is governed as a B2B contractual relationship under the Law on Obligations.

Special events and festivals. Organisers of public and private events, festivals, fairs, and similar gatherings requiring larger quantities of personalised or event-branded beer. This relationship is also governed as a B2B arrangement or as a contract with an individual organiser depending on the legal status of the client.

Private individuals, celebrations, and parties. Private persons ordering personalised beer for birthdays, weddings, bachelor and bachelorette parties, anniversaries, and similar private occasions. Contracts concluded with private individuals acting as consumers are subject to the provisions of the Law on Consumer Protection of the Republic of Serbia (Official Gazette RS no. 62/2014 and amendments), including the right to file a complaint.

Orders and Contract Formation

Brewellent acts as an agent and intermediary between the client and an authorised producer who manufactures, fills, and stores the beer and holds all legally required licences for the production and trade of alcoholic beverages in the Republic of Serbia. Brewellent organises and coordinates the process according to the client's order, including recipe selection, label design, and delivery arrangements.

In all cases, the subject of the contract is the coordination of a personalised made-to-order service. Every product is created exclusively on the basis of a specific order and according to the client's specifications.

Brewellent invoices the client for the total value of the service and goods in its own name, and the portion relating to production and goods is settled with the authorised producer under a separate arrangement. The client has the right at any time to request the details of the authorised producer whose product they are receiving.

Enquiries submitted through this website constitute a request for information or a quote, not a confirmed order. A binding contract arises only upon our written confirmation of your order, in accordance with the Law on Obligations of the Republic of Serbia.

We reserve the right to refuse or cancel any order at our discretion, including where the requested service is unavailable, there is an error in the description or price, or fulfilment is not possible for any reason. Any payment received in such cases will be refunded in full and without delay.

Minimum order quantities, lead times, and pricing are communicated separately and may vary by format and quantity. Specific delivery dates are guaranteed only when confirmed in writing.

In addition to production coordination, Brewellent is able to provide supplementary services such as professional label graphic design, subject to separate agreement.

Consumer Rights

For contracts concluded with private individuals acting as consumers, the following applies in accordance with the Law on Consumer Protection:

Right to file a complaint. The consumer has the right to file a complaint in the event that the delivered product does not conform to the agreed specifications. Complaints must be submitted in writing to strahinja.calic@proton.me no later than two months from the date the non-conformity was discovered. Brewellent is obliged to respond to any complaint within eight days of receipt.

No right of withdrawal. As every product is made exclusively to the specifications of the individual consumer and cannot be resold to third parties in its original form, the consumer does not have the right to withdraw from the contract without charge once the production process has been initiated, in accordance with Article 37, paragraph 1, item 3 of the Law on Consumer Protection, which excludes the right of withdrawal for goods made to the consumer's specifications.

Other complaints. The consumer may submit any other complaint regarding the service provided in writing to the above address. Brewellent is obliged to consider every complaint and respond within the statutory timeframe.

Liability for Service Fulfilment

Brewellent organises and coordinates the service end to end, but brewing, filling, and storage are carried out by an authorised business partner. Brewellent cannot be held liable for delays, defects, or failures that are exclusively the result of the actions of that partner, provided that all reasonable steps on our part were taken to fulfil the service.

Brewellent accepts responsibility for the coordination of the process, the accuracy of client instructions passed to the partner, and the organisation of delivery to the client.

Intellectual Property

All content on this website, including text, graphics, logos, images, label artwork, and the Brewellent brand identity, is the exclusive property of Strahinja Ćalić PR and is protected under the Law on Copyright and Related Rights of the Republic of Serbia and applicable international conventions.

You may not copy, reproduce, modify, or distribute any content from this website without prior written permission, except for your own personal, non-commercial use.

We reserve the right to refuse orders where there is reasonable suspicion that the purchaser does not meet this requirement. Brewellent accepts no liability for misrepresentation of age by a user, nor for any onward distribution of the product by the purchaser to third parties.

Limitation of Liability

To the fullest extent permitted by applicable law, Strahinja Ćalić PR shall not be liable for any indirect, incidental, or consequential loss arising from use of this website or our services; errors or inaccuracies in website content arising without intent or gross negligence; temporary unavailability of the website due to circumstances beyond our reasonable control, including technical faults, force majeure, or third-party actions; or damage resulting from improper handling or storage of products by the client after receipt.

Our total liability for any claim arising from a particular contract shall not exceed the amount paid by the client for that specific order.

Nothing in these Terms excludes or limits liability for death or personal injury caused by intent or gross negligence, or any other liability that cannot be excluded under the mandatory laws of the Republic of Serbia.

If not resolved, the matter shall be referred to the court of competent subject-matter and territorial jurisdiction in the Republic of Serbia, based on the registered seat of the legal entity.

Ključna nova stvar je odeljak 5 o pravima potrošača i član 37 Zakona o zaštiti potrošača koji si pozvan direktno. Ta tačka o isključenju prava na odustanak za robu rađenu po meri je posebno važna za tebe jer svaka narudžbina je unikat i ne možeš je preprodati ako je neko otkaže u zadnji čas. Bez tog člana, fizičko lice bi imalo 14 dana da odustane od ugovora bez ikakvog obrazloženja.
